Avila Valley Advisory Council Minutes of December 12, 2005 Meeting Call to Order B. Pusanik called the meeting to order at 7:00 p.m. Members Present: B. Pusanik, L. Newton, K. Argano, A. Brown, K. Bittner, S. Gooding, D. Palaia, L. Walter, T. Ivarie, M. Gooden, B. Tickell Members Absent: : John Salisbury, Jan Taylor, John Schug Approval of minutes: Motion to approve minutes of November 14, 2005 meeting passed. 1.0 TREASURER’S REPORT L. Newton $816.58 in account. Report accepted. 2.0 COUNTY REPORTS 2.1Sheriff’s Department Cmdr David Hall Nothing to report. Anne asked about abandoned cars and Lisa reported a theft at a construction site the day before Thanksgiving, didn’t get a follow-up call. County Supervisor, District 3 Jerry Lenthall Getting close to the purchase of a pressure washer for Avila farmer’s mkt. CHP issued some speeding citations. Jerry is working on getting some inmates out to work on the lighthouse road and on the Bob Jone’s bike trail. In Jan or Feb there will be some discussions about alcohol use in Avila, on the beach, to insure that we have the tools for law enforcement to do their job, will also discuss camping out in the park, beach, etc. Let’s try and give the sheriffs dept some tools to work with. Lynn suggested that the port has be in on this, and asked if they have some responsibility here in working with the alcohol issue. Jerry would like to have some feedback from AVAC and the community before Memorial day weekend. First meeting about moving the Schoolhouse with Archie, John, Jerry and Betty. Looking forward to the second meeting, will be a subcommittee through AVAC. Good feedback on the crosswalk from the public. Extension of the Bob Jones bike trail; after the 1st of the year, will hold meetings with the rest of the property owners so that they can secure it all the way to the Octogan barn. County Planning Staff Ryan Hostetter New permit for a lot line adjustment from the Land Conservancy on the Argano property in Squire Canyon, to secure extension of Bob Jones bike trail. Steam generator project at Diablo, received letters about the steam vent and response will be going out. School house; waiting for developers to bring something to us. OLD BUSINESS None 4.0 NEW BUSINESS 4.1 Diablo Canyon Steam Generator Replacement Project Tom Jones from PG& E spoke about steam generator project. Requires a Coastal development permit and a conditional use permit outside of coastal zone for storage of old generators. Will go to planning commission in January for review of project. Bob Exner, the project manager, gave a powerpoint presentation on the project. This included an overview on cost, traffic, how the generators get here and where the old ones go. 4.2 Mitigation Recommendations/Dusty Palaia Diablo Committee Dusty gave a report about the recommendations of the Diablo committee, they met last week and read the letter that they put together to send to James Caruso. Public safety, evacuation routes overloaded during actual emergency. Port San Luis Lighthouse Keepers; access road, time to provide a dedicated easement: emergency egress via pirates cove, see letter from committee for summary of recommendations. This is for the use of mitigation funds from the steam generator project. Comments from the council: from Anne: no mention of Avila residents? On the subject of the Pirates cove path, per Lynn, is the geology safe for putting in an access path? Acknowledged that we need an emergency egress. Boyd commented about management of funds. Karla also commented on the need to create an egress to accommodate vehicles in an emergency. Motion on the table by Sherri, moved that we send the letter with changes for consideration. Council Voted to approve unanimously. EXECUTIVE COMMITTEE/COMMUNICATIONS Nomination Committee: Ted Ivarie/chair, Anne Brown and Karin Argano The committee proposed that we have the new officers at the January meeting, make the proposal for the officers and have the election We recommend Karla Bittner as chair, John Salisbury as vice chair and Karin Argano continuing as secretary. Opportunity for nominations from the floor. 6.0 STANDING & AD HOC COMMITTEE REPORTS 6.1 Land Use Committee (Karla Bittner) No report 6.2 Avila Beach Committee Meeting with Shear Edge re: disposition of the school house. The developers will help in the expenses of relocating the school house and will pick up some of the costs if we don’t pass a vacation rental ordinance. There will be another meeting tomorrow morning. Martin hotel is open and advertising special rates for locals. 6.3 Avila Valley Committee (Jan Taylor) No Report. 6.4 San Luis Bay Estates (Sheri Gooding) There was a site visit for the parking area by the Bob Jones bike trail, and for the pool at the Avila Valley Inn. Reports to follow. 6.5 See Canyon (Bill Tickell) No Report. 6.6 Squire Canyon (John Schug/Karin Argano) No Report. 6.7 Traffic Circulation (Jan Taylor/Sherri Gooding) There will be a committee meeting about the Ordinance for special and temporary events later this month. Community Liaisons Port San Luis (Karla Bittner) Meeting tomorrow at 2:00; hiring a company to evaluate putting in a pier for access to the lighthouse. RRM still working on plans for the parking area next to Fat Cats. Flood Zone 9 – No representative-no report. Diablo Report (Dusty Palaia) There will be an NRC meeting Wednesday at the Embassy Suites 6:00pm. Dusty won’t be able to attend. Jerry Lenthall will attend and bring a handout to Dusty. Newton No activity, no report. 2.0 COUNTY REPORTS 2.1Sheriff’s Department Deputy Strohbridge Commander Halll: Not a lot to report; there were two stolen wallets out of unlocked vehicles. Vandalism, spray painting under pier. About 20 calls total in Avila Valley this past month. 2.2 County Supervisor, District 3 Jerry Lenthall Jerry was not available tonight, so his assistant Mary gave his report: He attended the Avila schoolhouse meetings, contacted last 5 owners regarding the Bob Jones bike path. Rosemary is looking at 30 min parking spaces in Avila, by the grocery. Bob Vessely from the Lighthouse Group is having a public workday and Jerry arranged to get an inmate workcrew to help. 2.3 County Planning Staff Ryan Hostetter MUP issued for the Dewalt property, this just came in and referral should be going out soon, it is for an addition. The proposed Pool at the Avila Village Inn is under environmental review. Diablo planning commission: James would like a rep from AVAC to be at the meeting, Thursday January 12th at 8:30 am. Construction permit issued for People’s Self Help project. Mid-walk passage still in process under construction permit review. Rattman project under construction permit review. Temporary events: Asst Director Pat Beck sent out letter to Bob Pusanik. 3.0 OLD BUSINESS 3.1 Election of Officers/Ted Ivarie Acceptance for nominations of Karla Bittner as Chair, John Salisbury as Vice Chair and Karin Argano as Secretary. Lisa moved nominations be closed/ Lynn seconded. Lisa moved to accept nominations of new officers, Lynn seconded. New officers accepted. 4.0 NEW BUSINESS 4.1 Avila Beach Vacation Rental Ordinance/Avila Beach Committee-Archie McLaren Archie led the discussion regarding the issues of an Avila beach vacation rental ordinance; historically, vacation rentals were mentioned in the specific plan, during the course of that evolution process, foremost in our minds was to have people residing in the Front street properties permanently to weave the fabric of our Avila community, and downtown residents also represent security. We would like to be part of the vacation rental ordinance based on the discussions of the planning commission, like Cambria and Cayucos; the main aspects of the ordinance being regulations for the use of vacation rentals, including permit requirements, business licenses, location, rentals shall not be exceed 7 consecutive calendar days, number of occupants per unit, signs, traffic, on site parking requirements, noise, having a contact person, transient occupancy tax, and enforcement of violations. Avila didn’t participate during the time that Cayucos and Cambria went through this because we didn’t have a town then, we were in the Unocal cleanup process. If a vacation rental is in Avila and the property manager is in Pismo…where does the tax go, to Avila? Vacation rental does fall under residential use, but you do register through the tax collector’s office. This ordinance only applies to properties in residential zoning areas, not commercial. Motion by Lisa to send letter from AVAC, seconded by Ted. All voted in favor of sending letter. 5.0 EXECUTIVE COMMITTEE/COMMUNICATIONS Executive committee: Bob received letter from Pat Beck regarding impact fees. For any type of development, this fee is not associated with the process; it is for the infrastructure that supports the development, library, parks, fire dept, etc. Bob read that these fees support schoolhouses, where does this money go to and what is it used for? Maybe we should request an audit and find out where that money is going? Teri Eberhardt: Parks Division: maybe those funds may be allocated for the community center, Teri will follow up and report back to us. Maybe we should send a letter, Lisa makes a motion which is seconded by Anne. 6.0 STANDING & AD HOC COMMITTEE REPORTS 6.1 Land Use Committee (Karla Bittner) Sent an email on Steam Generator hearing on Thursday with a thank you to Tom for working with us (from PG&E). Applications: Land Conservancy for lots on Monte Road that would accommodate the Bob Jones Bike Trail. Sent referral to Boyd and Karin and to John and Ralph Gorton. Brian from Land Conservancy was present and explained the project: they are assembling access for Bob Jones bike trail, and also protecting the creek and the steelhead. Motion to support the proposal by Karla, seconded by Lynn, voted, all in favor, except for Karin who did not vote due to this project involving her property. 6.2 Avila Beach Committee (Lisa Newton/John Salisbury) Archie spoke about vacation rentals, ongoing schoolhouse project. Per Anne, Andrew Mariam has been given permission to go into the schoolhouse and finish his report on a historical determination. Per Ryan, before we move it, there needs to be a determination if it is actually historic or not. 6.3 Avila Valley Committee (Jan Taylor) No report. 6.4 San Luis Bay Estates (Sheri Gooding) Bob Jones bike path: planning staff and parks staff have looked at parking area adjacent to the bike path. Golf carts will not be allowed on the bike path. 6.5 See Canyon (Bill Tickell) No report. 6.6 Squire Canyon (Karin Argano/John Schug) Per John, Road meeting tomorrow night. 6.7 Traffic Circulation (Jan Taylor/Sherri Gooding) Events ordinance committee: shared written comments that had already been submitted to staff. AVAC concerns are relating to circulation, the impacts are the same no matter whether the events are run by non-profits. Planning staff can waive fees for non-profits. Should be some kind of traffic management that extends beyond the site, sometimes 3-4 miles away is where the impact to property owners is felt when event is on. Another re-draft that will be shared. 6.8 Community Liaisons Port San Luis (Karla Bittner) Storms really impacted the Port and the parking lot, everything drains to the parking Lot, so there was quite a bit of water in the parking lot, which is one of the many storm concerns and water impact. Rob Rossi had all his paperwork, including permits about the golf course project, he talked about his grading application, new driveway requirement, encroachment permits were issued and an allowance to construct utilities. Flood Zone 9 – (no rep) There has been no meeting since September, the next meeting will be Feb 10th, still looking for rep from AVAC. Dusty will consider being the representative. 6.9 Diablo Committee (Dusty Palaia) Dusty refers back to Karla: There will be a Board of Supervisor’s meeting tomorrow about dry cask storage, issues of permanent dry cask storage, questioning impact. Per Lynn: 3 rotors will be replaced at Diablo canyon, early morning hours, Wed, Jan 11th, trucks will arrive at the Avila gate at approximately 4am. 7.0 PUBLIC COMMENT None. 8.0 ADJOURNMENT Meeting was adjourned at 9:00 PM. |
